Under the the rule of law , no one violating a law escapes punishment , no one who does not violate a law loses his life , personal liberty , property and freedoms.Does India pass the test ? No. Had there been the rule of law Rajiv Gandhi would have been in jail for the massacre of the Sikh.Had there been the rule of law , Modi along with his cohorts been in jail .Had there been the rule of law , all mainstream politicians who shamelessly spend black money would have been behind the bars .Had there been the rule of law, all public servants would have been behind the bars.But the criminals of Gujarat are ruling us and delivering sermon on patriotism.Had there been the rule of law ,35000 innocent citizens would not have been behind the bars under MISA and two times more under DIR and other laws.Had there been the rule of law,76000 persons ( all innocent barring a few ) would not have been in prison under TADA (Anti-terror law of 1980s ) or POTA .Had there been the rule of law , thousands would not have been languishing in prisons even under ordinary laws .Had there been the rule of law , lakhs of Adivasis would not have been driven out of their home and hearth.The list of the victims of the phony rule of law is endless.
We are not under the rule of law but under the Rule by Law, which is actually the rule of the ruler masquerading as the rule of law.Parliament and Assemblies pass lawless laws, the poor citizen rushes to the judiciary, makes his submission only to hear the Lordships declaring them constitutional i.e.lawful .They say the last word and the curtain falls.
To liberate themselves , the people must tear the facade, the mask veiling the ugly reality of the rule of the rulers masquerading as the rule of law and fight for the actual Rule of Law.
